Terms of Service

1. What we are

bitcoiners.ae (the "Service") provides software-as-a-service for managing Bitcoin-related activities. The Service is operated by Benjamin Bois, sole proprietor (the "Operator"), pending incorporation of a UAE legal entity, at which point that entity will take over the Service operation without changing these Terms.

The Service is software only. We do not custody your Bitcoin, AED, or any other asset. We do not act as a broker, dealer, exchange, or financial advisor. Every trade or transaction you initiate through our software is your own decision, executed on accounts you own at third-party venues (e.g. BitOasis, OKX, Binance) using API credentials you provide.

2. Eligibility

• You must be at least 18 years old.
• You may not use the Service from a jurisdiction where the underlying activity (e.g. cryptocurrency trading) is illegal.
• You agree not to use the Service while subject to sanctions imposed by the UN, EU, US OFAC, UK HMT, or UAE authorities.

3. Subscriptions and billing

The Service offers free and paid tiers. Paid tiers are billed monthly or annually in advance. By starting a paid subscription you authorise us to charge your selected payment method (card via Stripe, or one-shot Bitcoin Lightning invoice via BTCPay) for the agreed fee.

Monthly subscriptions auto-renew until cancelled. You can cancel from your account page at any time; cancellation takes effect at the end of the current paid period. Annual subscriptions paid via BTCPay are non-refundable but you retain full access until the period ends.

Refunds for monthly subscriptions are at our discretion; we generally refund within 7 days of first payment if no material use of the Service has occurred.

4. Your responsibilities

• You are solely responsible for the API credentials you upload to the Service. We recommend trade-only scope; we recommend IP-whitelisting; we recommend never giving the Service the ability to withdraw to addresses you do not control.
• You are solely responsible for the consequences of the strategies you configure. The Service follows your instructions mechanically — it does not second-guess them.
• You are responsible for compliance with your local tax, reporting, and capital-controls laws regarding Bitcoin and cryptocurrency holdings.

5. No advice, no guarantees

Nothing the Service says, shows, computes, or alerts on constitutes investment advice, tax advice, or legal advice. The Service may display historical backtest results — these are inherently hypothetical and do not guarantee future performance. You assume all financial risk associated with your use of the Service.

6. Availability

We target high availability but do not guarantee uptime. The Service may be unavailable for scheduled maintenance, third-party outages (your exchange, our hosting provider, your internet), or unforeseen incidents. We are not liable for trades that did not occur because of an outage.

7. Limitation of liability

To the maximum extent permitted by UAE law, the Operator's total liability for any claim arising out of or related to the Service is limited to the fees you paid us in the 12 months preceding the claim.

8. Termination

You may terminate at any time by cancelling your subscription and deleting your account. We may terminate or suspend your account if you violate these Terms, attempt to abuse or compromise the Service, or use the Service from a sanctioned jurisdiction. On termination we delete your stored data within 30 days, except billing records we are required to retain for tax purposes.

9. Changes

We may update these Terms by posting a new version with an updated "Last updated" date. Material changes will be emailed to all active subscribers at least 14 days before they take effect.

10. Governing law

These Terms are governed by the laws of the United Arab Emirates. Disputes will be resolved in the courts of Dubai, save where applicable consumer-protection law mandates otherwise.
